Johnson & Johnson is being sued in federal court by consumers who aren’t happy with the company’s reimbursement plan for those who bought recalled drugs.  The company offered coupons or replacement products after being forced to recall children’s Tylenol and other over-the-counter pediatric medicines.  Five complaints filed this week in Northern Illinois accuse J&J of fraud and racketeering for not recalling all of its children’s drugs.  In addition, the suits say the company should have offered consumers an opportunity to fully recover their out-of-pocket expenses. 

In late April, J&J took more than 40 nonprescription products off store shelves in what the Food and Drug Administration called the largest recall of children’s medicine in the agency’s history.
